These Terms of Service ("Terms") govern your access to and use of the websites and applications operated by Qubrix Technode Private Limited ("Qubrix Technode", "we", "us" or "our"), a company registered in India, including qubrixtechnode.com and the Zesday food delivery platform (together, the "Services"). By using the Services, you agree to these Terms.

1. About Zesday

Zesday is an online marketplace that connects customers with independent restaurant partners and delivery riders. Restaurants are responsible for preparing food; Zesday facilitates ordering, payment and delivery logistics. Zesday is a product of Qubrix Technode Private Limited, India.

2. Eligibility & Accounts

• You must be at least 18 years old to create an account and place orders.
• You are responsible for the accuracy of the information on your account and for keeping your credentials secure.
• We may suspend or terminate accounts involved in fraud, abuse, or violation of these Terms.

3. Orders, Pricing & Payment

• Prices, delivery fees and applicable taxes (including GST) are shown as an itemised bill before you confirm an order. The amount shown at checkout is the amount you pay.
• Once a restaurant accepts an order, preparation begins; cancellation after acceptance may be subject to a fee reflecting costs already incurred.
• Payments are processed through secure third-party payment providers. Cash on delivery may be available in supported areas.
• Tips added at checkout are passed through to the delivery rider in full.

4. Delivery

• Delivery estimates are genuine estimates, not guarantees; actual times vary with distance, traffic, weather and restaurant preparation.
• You must provide an accurate delivery address and be reachable at the phone number on the order.
• Live tracking is provided for transparency where available.

5. Refunds & Support

If something goes wrong with an order — missing items, quality issues, or non-delivery — contact support through the app or at qubrixtechnode@gmail.com. Refunds are assessed case by case and, where approved, issued to the original payment method or as platform credit.

6. Acceptable Use

• Do not misuse the Services, including attempting to defraud the platform, restaurants or riders.
• Do not post unlawful, misleading or abusive content in reviews or communications.
• Do not interfere with the operation or security of the Services.

7. Reviews & Content

You retain ownership of content you post (such as reviews and photos), and grant us a non-exclusive licence to display it on the Services. We may remove content that violates these Terms or applicable law.

8. Intellectual Property

The Services, including the Zesday and Qubrix Technode names, logos, software and design, are the property of Qubrix Technode Private Limited and are protected by applicable intellectual property laws. You may not use our marks without prior written permission.

9. Disclaimers & Limitation of Liability

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Qubrix Technode disclaims implied warranties and is not liable for indirect or consequential losses. Nothing in these Terms limits liability that cannot be limited under Indian law, including in cases of fraud or wilful misconduct. Our aggregate liability for any order is limited to the amount paid for that order.

10. Governing Law

These Terms are governed by the laws of India. Courts of competent jurisdiction in India shall have exclusive jurisdiction over disputes arising from these Terms or the Services.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated date. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
